Privacy Policy

ThereWhen, Inc. (“ThereWhen,” “we,” “us,” or “our”) cares about your privacy. Our members and their families trust us with sensitive information, and we take that seriously. This policy explains what we collect, how we use it, and the choices you have.
1. Information we collect
We collect information you give us and information we gather as you use the Service:
- Contact and account details — name, email address, phone number, mailing address, and the details you provide when you inquire, sign up, or set your preferences.
- Member and care information — information you or your family choose to share so we can provide good care, such as the member’s needs, preferences, schedule, and notes relevant to their support. Some of this may relate to health or well-being.
- Payment information — membership payments are processed by our payment provider (Stripe). We receive limited details such as the last four digits and status of a payment, but we do not store your full card number.
- Communications — messages, emails, and texts you exchange with us, including visit updates and notifications.
- Usage and device information — basic technical data such as your device type, browser, and how you interact with our site, collected through cookies and similar technologies.
2. How we use your information
We use your information to:
- Provide, schedule, and coordinate visits and services.
- Match you with a companion and keep your care consistent.
- Process payments and manage your membership.
- Send you service messages — visit notes, schedule changes, and account or billing notices — through the channels you’ve enabled.
- Respond to your questions and provide support.
- Improve, secure, and maintain the Service.
- Comply with our legal obligations.
3. How we share your information
We do not sell your personal information. We share it only as needed to run the Service:
- With your care team. Companions and staff involved in your care receive the information they need to help you well.
- With family members you designate. If you add a family contact, we may share visit updates and related information with them.
- With service providers. We use trusted third parties to operate the Service — for example, payment processing, text-message and email delivery, and hosting. They may only use your information to perform services for us.
- For legal reasons. We may share information when required by law, to enforce our terms, or to protect the rights, safety, and property of our members, our people, or the public.
- In a business transfer. If ThereWhen is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction.
Your mobile phone number and your consent to receive text messages are treated differently from everything else described above. See Text messages below.
4. Text messages
Text notifications are off by default. If you turn them on in your account preferences, we use your mobile number to send you service messages about your membership — visit updates, schedule changes, updates to requests you’ve made, and billing notices. We do not send marketing or promotional texts.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
To deliver these messages we use a text-messaging provider (Twilio), which acts as our service provider: it processes your number only to send messages on our behalf and may not use it for its own purposes.
You can stop text messages at any time by replying STOP to any message, or by turning text notifications off in your preferences. Reply HELP for help, or email us at help@therewhen.co. Message frequency varies, and message and data rates may apply — see our Terms of Use for the full messaging terms. Opting out of texts does not cancel your membership; we will keep sending the same updates by email.
5. Cookies
We use cookies and similar technologies to make the site work, remember your preferences, and understand how the site is used. You can manage your choices as described in our Cookie Statement and through your browser settings.
6. How we protect your information
We use reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission or storage is completely secure, however, so we cannot guarantee absolute security. If we become aware of a breach that affects you, we will notify you as required by law.
7. How long we keep it
We keep your information for as long as your account is active and as needed to provide the Service, and afterward as necessary to meet legal, accounting, or reporting requirements. When information is no longer needed, we take steps to delete or de-identify it.
8. Your choices and rights
You can:
- Update your contact details and preferences in your account.
- Choose which notifications you receive, and turn text notifications on or off at any time — in your preferences, or by replying STOP to any text. See Text messages.
- Request access to, correction of, or deletion of your personal information, subject to legal limits.
Depending on where you live, you may have additional rights under applicable privacy laws. To exercise any of these, email us at help@therewhen.co and we’ll respond as required by law.
9. Children’s privacy
The Service is intended for adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, please contact us so we can remove it.
10. Changes to this policy
We may update this policy from time to time. When we make material changes, we’ll update the effective date above and, where appropriate, notify you. Please review it periodically.
